Copyright Policy

Summary: You are responsible for having the rights to whatever you upload. We use your uploads only to generate your personal study questions - not to redistribute your materials. We respond to valid copyright takedown notices, and our own platform and software remain ours.
1. Our Commitment
KIALS respects intellectual property rights and expects users to do the same. This Copyright Policy explains how we handle copyright matters on our platform, including user-uploaded content and our own proprietary materials.
2. Your Responsibility for Uploaded Content
By uploading any document to KIALS, you represent and warrant that:
- You own the copyright to the uploaded content, OR
- You have explicit permission from the copyright holder to upload and process the content, OR
- Your use of the content qualifies as fair use or fair dealing under applicable law for personal educational purposes.
KIALS processes your uploaded content solely to generate personalized study questions for your personal or internal organizational learning. This is not a license to reproduce, distribute, or commercially exploit third-party copyrighted materials.
Examples of content you likely have the right to upload:
- Your own notes, summaries, or study materials you created;
- Materials your institution or employer has licensed for your use;
- Textbooks or courses you have purchased, used strictly for your own personal study.
Examples of content you likely do NOT have the right to upload:
- Copyrighted textbooks or course materials you intend to share with others;
- Materials downloaded or obtained without authorization;
- Content you plan to use commercially or distribute.
3. KIALS's Intellectual Property
The KIALS platform - including its proprietary question-generation technology, user interface, and all related software and content - is the intellectual property of Know-It-All Learning Systems, protected by copyright, trademark, and trade-secret law. (KIALS's original question-generation method was covered by U.S. Patent No. 8,082,505 B2, which has since expired.) You may not copy, reproduce, distribute, or create derivative works of any KIALS platform component without written permission. “KIALS” and the KIALS logo are trademarks of Know-It-All Learning Systems and may not be used without our prior written permission.
4. AI-Generated Questions
Questions generated by KIALS from your uploaded content are licensed to you for your personal use within the platform. You may not:
- Export and sell generated questions;
- Redistribute generated questions as a commercial product;
- Use generated questions to train competing AI systems.
These questions are licensed for your personal or internal organizational use within the Platform. For what counts as permitted use versus prohibited redistribution, see our Terms of Service.
5. DMCA Notice & Takedown
If you believe content on the KIALS platform infringes your copyright, please send a written notice to our designated agent containing:
- Your name, address, telephone number, and email address;
- Identification of the copyrighted work claimed to be infringed;
- Identification of the material claimed to be infringing, with sufficient detail to locate it;
- A statement that you have a good faith belief the use is not authorized;
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf;
- Your physical or electronic signature.

We review and respond to valid copyright notices promptly and remove or disable access to infringing material where appropriate.
6. Counter-Notification
If you believe your content was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to support@kials.com containing:
- Your name, address, telephone number, and email address;
- Identification of the material that was removed and the location at which it appeared before it was removed;
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;
- A statement that you consent to the jurisdiction of the U.S. federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which KIALS may be found), and that you will accept service of process from the party who filed the original notice or their agent;
- Your physical or electronic signature.
We will restore removed content within 10-14 business days unless the copyright owner files a court action seeking to restrain the allegedly infringing activity during that period.
7. Repeat Infringers
KIALS will terminate accounts of users who repeatedly infringe third-party copyright in appropriate circumstances.
